By accessing or using Fresqo ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

Fresqo is an AI-powered marketing asset generation platform that:

• Extracts brand identity from websites (colors, logos, fonts, tone)
• Generates marketing assets using artificial intelligence
• Provides a canvas editor for customization
• Allows download of generated assets in various formats

The Service uses third-party AI models and may produce varying results.

When you create an account with us, you must:

• Provide accurate, complete, and current information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be at least 18 years old to use this Service

You are responsible for all activities that occur under your account.

Free Trial: 7 days of access with limited generations (10 assets, 3 brand extractions).

Pro Plan: $19.99/month, billed monthly, includes unlimited generations.

Payment Terms: - Payments are processed securely through Stripe - You may cancel at any time; access continues until the end of your billing period - No refunds for partial months, except within 14 days of your first payment - We reserve the right to change pricing with 30 days notice

You agree NOT to:

• Use the Service for any illegal purposes
• Generate content that infringes copyrights, trademarks, or other intellectual property rights
• Attempt to reverse engineer, decompile, or extract the AI systems or algorithms
• Use automated tools to scrape, harvest, or extract data from the Service
• Share your account credentials with others or create multiple free trial accounts
• Generate harmful, abusive, defamatory, or misleading content
• Attempt to circumvent any usage limits or security measures
• Use the Service to compete directly with Fresqo

Your Content: - You retain ownership of your brand assets (logo, colors, content you upload) - You grant us a non-exclusive license to process your content solely for providing the Service

Generated Assets: - AI-generated assets are licensed to you for commercial use - This license is non-exclusive; similar assets may be generated for other users - You may use generated assets in your marketing materials

Our Property: - The AI models, algorithms, and Service platform remain our intellectual property - Fresqo name, logo, and branding are our trademarks

Disclaimer: - AI-generated content may not be unique or exclusive to you - We do not guarantee that generated content is free of third-party intellectual property rights - You are responsible for reviewing all content before commercial use - We recommend clearing any trademarks or copyrighted elements before publishing

Data Usage: - We may use anonymized and aggregated data to improve our AI models - Your specific brand data will not be shared with other users

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE ARE NOT LIABLE FOR: - Indirect, incidental, special, or consequential damages - Loss of profits, revenue, data, or business opportunities - Service interruptions, errors, or bugs - Actions of third parties - Content generated by the AI that may infringe third-party rights

MAXIMUM LIABILITY: Our total liability is limited to the amount you paid us in the past 12 months, or $100, whichever is greater.

You agree to indemnify and hold harmless Fresqo, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or generate through the Service

By Us: - We may terminate or suspend your account immediately for violations of these Terms - We may discontinue the Service with 30 days notice

By You: - You may terminate by canceling your subscription and deleting your account

Effect of Termination: - Your right to use the Service will cease immediately - Your data may be deleted after 30 days - Provisions that should survive termination will remain in effect

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the new Terms on this page
• Updating the "Last updated" date
• Sending an email to your registered address

Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Dispute Resolution: Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the American Arbitration Association rules. The arbitration will take place in Delaware.

You agree to waive any right to a jury trial or class action.
